Course Title   Training Course on Arbitration for Settlement of Disputes
       
Course Duration   Date: 20 June 2019 to 22 June 2019
Time: 9:am to 4:30 pm, 3 Days @ 6:30 Hours per day
       
Course Contents   Day 1: Overview of Alternative Dispute Resolution (ADR) issues important to public procurement pre-contract and post-contract dispute settlement mechanism; Understanding Differences/Disagreement/Problem/Dispute/Conflict, Mediation, Amicable Settlement, Adjudication, Arbitration; UNCITRAL Model Law and Rules, FIDIC, MDB, World Bank, ADB provisions in relation to right to complain and settlement of disputes; CPC, PPA, PPR, procurement standard documents provisions in relation to right to complain and settlement of disputes.

Day 2: Complain and Appeal process as per PPA/PPR; Mediation process; The Arbitration Act [I of 2001] - General Provisions, Arbitration Agreement, Appointment of Arbitrator/Composition including case references and useful tips/advice.

Day 3: Jurisdiction of Arbitral Tribunal, Conduct of Arbitral proceeding, Making of Arbitral Award and termination of proceedings including case references and useful tips/advice; Recourse against Arbitral Award, Role of relevant parties, Enforcement of Arbitral Awards, Recognition of Enforcement of Certain Foreign Arbitral awards, Appeals, Miscellaneous, etc. including case references and useful tips/advice.
       
Course Benefits   To learn by the participants, the Training Course on Arbitration for Settlement of Disputes will focus on the following, but not limited to:

  1. Provide a brief historic overview of Alternative Dispute Resolution (ADR) issues important to public procurement pre-contract and post-contract dispute settlement mechanism;
  2. Understanding Differences/Disagreement/Problem/Dispute/Conflict, Mediation, Amicable Settlement, Adjudication, Arbitration;
  3. UNCITRAL Model Law and Rules, FIDIC, MDB, World Bank, ADB, CPC, PPA, PPR, procurement standard documents provisions in relation to right to complain and settlement of disputes need to be aware of; and
  4. Complain and Appeal process as per PPA/PPR; The Arbitration Act [I of 2001] mainly regarding General Provisions, Arbitration Agreement, Appointment of Arbitrator/Composition, jurisdiction of Arbitral Tribunal, Conduct of Arbitral proceeding, Making of Arbitral Award and termination of proceedings, Recourse against Arbitral Award, Role of relevant parties etc. including case references and useful tips/advice.
